Opinion Judge:
The error asserted is of the very class which justifies the rule. There is no probability that it was prejudicial and the slightest timely hint would have cured it. Such are not the errors of which appellate courts, of their own motion, take cognizance solely to forestall a miscarriage of justice. BURKE, Justice.
